The Land Use committee focuses on land use issues such as zoning and planning.  This is one of the most important issues to all residents of Ouray County.  The committee is working on a variety of projects that will impact the future of sustainable growth in our county. Committee members meet regularly with county officials to stay abreast of current issues.


Goals: To monitor County public hearings and development and influence land use decisions in Ouray County.

 Proposed Land Use Code Modifications - Sections 6.13 & 22 Minimize

June 24, 2008 - ROCC recommends rejection of the proposed Land Use Code modifications to sections 6.13 and 22.  This change would eliminate the right of property owners to vote on changes to their Planned Unit Developments.  Read our letter to the County here...


  

 Proposed Land Use Code Modification - Section 30 Minimize

The Ouray Board of County Commissioners is currently considering a modification to the Land Use Code.  Section 30 is the focus of these changes and you can view or download a copy of the current draft below.  Please note that the commissioners' proposed changes are in red and the county staff's changes are in blue.  This is a working document, however we will make every attempt to keep it up to date. Watch the calendar for the coming Planning Commission working session where this document will be discussed.

In December of 2006 Ken Lipton wrote a letter to the BOCC expressing concerns about Section 30. The board agreed to attach his letter to the Section 30 draft when they sent it to the Planning commission.


  

 Cimarron Mesa North PUD Proposal Minimize

There is a pending development called Cimarron Mesa North which consists of a six lots on about 40 acres west and north of Colona in the North Mesa zone.

This parcel borders Department of Wildlife (DOW) wildland on the north. The proposed plat shows that the developer has allocated open space next to County Road 22 on the south. The open space is split by the access road to the building lots.  The DOW recommends moving the open space adjacent to the DOW land on the north to provide a better buffer for wild animals. The developer wants to put it in the irrigated agricultural land, because he feels it would provide a "calming habitat" for wild animals and it would support the goal of keeping agricultural lands open.

At the April 17th Planning Commission meeting, this development was approved without modification.


  

 Proposed Land Use Code Modification - Section 15 Minimize

The Ouray Board of County Commissioners is currently considering a modification to Section 15 of the Land Use Code. Section 15 pertains to Mobile Home Parks, Campgrounds and RV Parks and you can view or download a copy of the current draft below. This is a working document, however we will make every attempt to keep it up to date.

The proposed amendment has many positive aspects regarding the regulation of RV parks. However, it also contains some not-so-desirable provisions, like allowing RV parks to operate in the Valley, High Mesa, Public Lands and Alpine Zones.

On March 30, 2007 the Ouray County Newspapers published a letter to the Editor from Ken Lipton expressing his concerns about the Section 15 Amendment. It contains some interesting details about the potential impact of this amendment on Ouray County.


  

 Dave Wood Road Minimize

Ouray County, San Miguel County, and Montrose County are working together on issues of mutual interest, including the coordination of regional land use planning. Each county has its unique concerns. All parties are attempting to find common ground on which to manage this long term problem. A Memorandum of Understanding (MOU) has been created and the counties’ staffs will work together.

Dave Wood Road crosses all three counties as well as Forest Service land. There is growing pressure to improve it and perhaps make it a bypass to Telluride from Montrose. Areas of concern include:

  • Impact on wildlife
  • Public safety
  • Growth paying its own way
  • Environmental impacts

Alert! 10-20-06 Sign Up for BOCC, Planning Commission and CSIAC Email Notification List - The Ouray County Land Use Adminstrator maintains an email list of interested parties that would like to receive notifications about BOCC, Planning Commission and CSIAC reviews and topics. This is a great way to stay abreast of the issues that will impact all our lives in years to come. Theobald Study - Professor David Theobald, an expert in land use planning, has generously offered to do a study of land use alternatives in Ouray County at no cost to the County. His study provides County planners and citizens with more complete information than was previously available for making choices among land use alternatives.   Details...


Fiscal Impact Analysis - The Ouray Board of County Commissioners contracted with RPI Consulting Inc. to perform an in-depth analysis of the fiscal impact of development in Ouray County. The study shows clearly that rural development does not pay for itself and describes options for mitigating this problem.   Details...


The Land Use Forum - Wednesday, September 27, 2006 at 7:00 PM in the Ridgway Community Center.  A distinguished list of guest speakers was assembled to present and discuss various aspects of growth in Ouray County.  The forum was well attended by more than 80 Ouray County citizens who had an excellent opportunity to have direct access to real experts in land use.  Details...
